ARTIST EXHIBITION AGREEMENT**

This Exhibition Agreement ("Agreement") is made and entered into on ______________

Collectively referred to as the “Parties.”

1. Purpose

The Artist agrees to display their artwork at the Gallery for exhibition and potential sale under the terms described below.

2. Exhibition Details

  • Exhibition Title: __________________________________________

  • Exhibition Dates: ONE week from ______________ to ______________

  • Location: 654 Van Ness Ave, Fresno, CA 93721

  • Number of Works Displayed: __________

3. Delivery & Removal

  • The Artist will deliver the artworks to the Gallery no later than ______________.

  • The Artist will provide the Gallery with descriptions, measurements, and prices of all displayed pieces.

  • The Artist will remove all unsold works by ______________.

  • If not collected within 15 days, the Gallery reserves the right to store or dispose of unclaimed artwork at its discretion. The artist may be charged for storage.

4. Sales & Commission

  • The Gallery shall charge a $500.00 fee for the Thursday evening Art Hop event.

  • The Artist may host an additional reception event, within the dates agreed upon in section 2, for an extra fee of $200.00.

  • Payment to the Gallery must be made 30 days before the Thursday Art Hop event.

  • No Commission is charged for any sales made during the event.

5. Insurance & Liability

  • The Gallery is not responsible for insuring the artworks.

  • The Artist understands and agrees that the Gallery is not liable for theft, damage, or loss unless such loss results from gross negligence or willful misconduct of the Gallery.

  • It is recommended that each artist purchase a (one-time) event policy from ACT: Artists, crafters, and trade insurance.

6. Promotion

The Gallery may photograph and reproduce the artwork for promotional purposes, including but not limited to social media, websites, press releases, and printed materials.

7. Hold Harmless Clause

The Artist agrees to indemnify, defend, and hold harmless the Gallery and its employees, agents, and representatives from and against any claims, damages, liabilities, losses, or expenses (including reasonable attorneys’ fees) arising out of or related to:

  • the display and/or sale of the Artist's work,

  • any breach of this Agreement by the Artist, or

  • any act or omission by the Artist.

8. Termination

Either party may terminate this Agreement by providing 30 days' written notice. Upon termination, all unsold artwork shall be returned to the Artist within 15 days.

9. Entire Agreement

This Agreement constitutes the entire understanding between the parties and supersedes all prior agreements, written or oral. Any amendments must be in writing and signed by both parties.

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of California.
